 Question: My daughter is 17 and just moved into the a dorm at KU. On Friday night an officer came to their residence hall due to a complaint that someone smelled marijuana smoke. The officer went to several dorms checking. He came into her dorm room and asked for everyone's driver's license. Although it was clear the smoking didn't come from her room, she was told a "warning" would be placed on her driver's license. Is this true? This was upsetting not only to her since she's never been in trouble with the police, and to me as her parent that her DL would be flagged. Will you please explain her rights in this situation?
    Answer: This incident happened at KU, so it would have been handled by the University of Kansas Police Department. We do not have access to their records, so I can’t answer your questions. I would encourage you to contact KUPD at 785-864-5900.

 Question: My kids received a BB gun for Christmas. Is it even legal to shoot it in our West Lawrence neighborhood? (Harvard and Wak area)
    Answer: The simple answer to your question about shooting a BB gun in the city limits is 'yes'. But I say that with reservation. A BB gun is not a firearm by ATF definition and therefore is allowed to be fired within the city limits. However, it does meet the definition of a 'missile'. Here is the missile ordinance:

14-405 MISSILES- (A) No person in this City shall throw, bat or by other means propel any ball, stone or other hard substance into, on or across any street or alley in any public place or at or against any building or vehicle, or at or toward any person with the intent to strike, harm, injure or damage any person or property. (Ord. 8021)
(B) For the purposes of this Section, the act of throwing, batting, or by other means propelling any ball, stone or other hard substance into, on or across any street shall be deemed prima facie evidence of the intent to strike, harm, injure or damage other persons or property. (Ord. 8021)
(C) Exceptions. (Ord. 8021)
(1) It shall not be illegal under this Section to throw, bat or propel a ball toward any person with intent to strike that person when both the individual throwing, batting or propelling the ball and the person who is the target of the thrown, batted or propelled ball are consensually engaged in a sporting or recreational activity and the risk of being struck by a thrown, batted or propelled ball is an inherent part of that activity.
(2) It shall not be illegal under this Section for a person to throw, bat or propel a ball or other hard substance against a building with the intent to strike the building if the person has the permission of the owner of the building to conduct such activity. (Code 1979, 14-405; Ord. 5516, Ord. 8021)

If you shoot said BB gun on your own property and the BB happens to miss your target or ricochets and ends up crossing public property or strikes someone else's property, you have violated the missile ordinance.
