 Question: I'm doing a school project for my psychology class, and I was wonder what would be all the fines if a 19 year old boy had got a 2nd D.U.I?
    Answer: Specific penalties and fines for charges such as DWI or OUI are decided upon by the Court of jurisdiction. You may contact the Clerk of the District Court or the Clerk of the Municipal Court to find out the range for the associated fines and penalties. For State violations, you may access fines and penalties online under the corresponding Kansas statute at the State of Kansas website.

 Question: If there are robberies going on in a neighborhood, is it better to report it? I have a friend who has lost all hope in the judicial, justice system and I want to renew his faith. Would we have to go through the department with a report before making a claim to the insurance company?
    Answer: Yes, It is always better to report crimes. An unreported crime has no chance of being solved. Not all crimes are solved but by reporting the crime the officer may discoverd valuable information that solves the crime and possibly other crimes as well. The crime can be reported at the department that has juristiction over where the crime occured.

 Question: Years ago, the city police dept. recorded every pawnshop transaction that occurred. I believe the purpose was to look for stolen goods but there were too many transactions to keep up with them. Do you still do this at all?
    Answer: Yes. The department still receives information from the pawn shops and tracks the information.

 Question: Is it legal to shoot a bb/pellet gun in your backyard--there are woods behind our yard--at a target. If not is there a range or area ie. public land close to lawrence where it would be appropriate. Thank you for your time.
    Answer: It is illegal to shoot a bb/pellet gun in the city limits. 14-407 DISCHARGING FIREARMS. No person shall discharge or fire off any firearms of any kind within this City. The provisions of this Section shall not apply however, to the discharge of firearms by officers of the law, when necessary in the discharge of their official duties, to the discharge of firearms in any licensed shooting gallery in this City, to any officer or enlisted man of the Kansas National Guard while in the discharge of his or her duty, or to any person using such firearm to lawfully defend his or her person, property or dwelling.  Question: Is it really illegal to back into a metered parking spot (in the library parking lot)? If so, why is there no signage? I have never heard of this before.
    Answer: Section 89.1 covers backing into metered spaces. 17-109.1 AMENDMENTS TO STO; STALL PARKING. Section 89 of the Standard Traffic Ordinance is hereby changed to read as follows: (Ord. 7674) Sec. 89. Stall Parking. Where parking stalls or spaces are marked or designated on the pavement or curb, vehicles shall be parked or stopped within such stalls or spaces in the direction of the flow of traffic or at the angle indicated by the markings. Sec. 89.1. Metered Parking. Where parking stalls or spaces are metered no vehicle shall be backed into the parking stall or space.

 Question: What is the burden of proof for a noise complaint? For example, if I were to call in an noise complaint on a residence that isn't making "excessive, unreasonable or unusually loud noise" what would happen to that residence?
    Answer: If the officer does not hear any noise than they may still take a report for the reporting party. If a report is taken the officer should attempt to contact all persons involved and get statements. The report will be forwareded to municipal court and they will determine if there is enough evidence to prosecute the case.

 Question: I and my friend want to exchange our cars for a week or so. Both of us have our cars insured and valid driver licenses. Is that legal?
    Answer: As long as your friend has your permission to drive your vehicle that yes.

 Question: My car was towed without my permission or notification from a legal parking spot several weeks ago. It was left parked diagonally across several parking spots. My car was not working, so i could not move it back. Today, my car was again towed without my permission or notification. What do I do to get my car back?
    Answer: A vehicle can be towed from a private parking lot by the owner of the propery or someone who the property owner give authorization to tow. You would need to contact the property owner to duscuss why your vehicle was towed. The police departments only involvement is to determine if the car is stolen and to log the tow.

 Question: I recently had a security system installed in my home. Do I need to have it registered if I live in Lawrence (Douglas county)? The installers told me to ask the police department because it is ever changing. If it changes frequently how are residents with systems to know this?
    Answer: Currently an alarm permit is required by the city. You can find more information at the city website www.lawrenceks.org.

 Question: Hello I am a CPL in the U.S. Army, and I will be getting out of the army soon, and I am interested in pursuing a career in Law Enforcement, and I was wondering about the LPD's policy regarding tattoos below the elbow. Are they allowed, discouraged, or grounds for not being considered for employment.
    Answer: The guidelines for tattoos can be found in Lawrence Police Policy Manual under 4.3 personal appearance. The policy manual can be found online at www.lawrencepolice.org.

 Question: Hi there, my daughter is attending school there in Lawrence in the summer. where can I find self-defense laws for the state of Kansas?
    Answer: Kansas Criminal Code can be found online at www.kslegislature.org. Crime and punishment are in Chapter 21.

 Question: I received a W2 from a company I have never worked at with the KS I.D. number of someone who has stolen my identity at the age of 18, can i have this number ran so i can look at the face of the imposter to see if i can identifiy them myself? I just recieved my birth certificate less than 2 months ago and my own I.D. even less than that I have no idea how someone could have gotten my information before I even did.
    Answer: The Kansas Department of Revenue might be able to assist you with your request. If you have not filed a report for Identity Theft you can do so with the police department.

 Question: Does the department offer ride-alongs for those who are interested in Law Enforcement? Are there any requirements for this and who would you contact to set this up?
    Answer: You would need to make a formal request in writing to the Chief of Police.

 Question: I live in an apartment and frequently hear my neighbors viciously beating and cursing at their dog. I have no way of knowing if the animal is physically injured, nor can I provide any proof. I am worried about the well being of the animal, and not to mention the sounds are quite disturbing. Is there anything I can do?
    Answer: You should file a police report. If you can, call the officer when you hear or observe the animal being abused.

 Question: In a situation of domestic abuse, when can the children be removed by the state? I understand that if the mother repeatedly goes back to the abuser she chooses the be in that situation, but the kids have no choice. Is there really nothing that can be done? If the child throws up when she sees the father? If this same child wets the bed at night because she is afraid to come out of her room, isn't that an indication of a serious problem? Is there a point when the family can step in? What are the laws protecting children, and how far does the situation need to go before they will be helped?
    Answer: The decision to remove any child from a home can only be made after the Department of Social and Rehabilitation Services, many times in conjunction with an investigation by the Lawrence Police Department, determines that such an outcome is recommended. Even then, the final decision will be up to a District Court Judge. The initial step would be to file a report, either with SRS or the LPD. The legal questions should be referred to an attorney.

 Question: Hello: I'm president of a Florida based Limited Liability Company that provides internet marketing and software systems to small businesses. We had a resident in Lawrence KS provide some website services for us including creating video files for a corporate web site. This young man [who is an independent contractor] took videos we provided him so that he could "encode" them to a different format in order for us to play these corporate videos on our website which we gave him access to. We have found out that this young man took down the videos from our website, without our permission and has our company owned videos on his personal computer, and is unwilling to turn them over to us. This is negatively effecting our customers and our company. We see this as clear theft. We can certainly file a lawsuit, but that doesn't help us in the very worrisome short term. Therefore, can we have this person arrested? What are our options?
    Answer: You may file a police report. Depending on the facts of the investigation, there are several outcomes of that filing: 1) The prosecutor could issue an arrest warrant, 2) The officer could interview and determine that an arrest is warranted, 3) The officer takes a report, but no arrests are made. In this final instance, a civil suit will be your best recourse.

 Question: If someone borrows something from you and it's been months and you've asked for it back time and time again and they won't return it, what can be done from a legal standpoint? Can a report be filed for theft?
    Answer: You may file a police report. The officer will determine the correct statute for the violation after visiting with you. Prosecutors have the prerogative to change the charging statute before the case is arraigned.

 Question: Do I need to file an accident report if a person backed into me? No damage was done to either vehicle. The other person involved (who is at fault) has filed a report. Am i obligated to do the same?
    Answer: The answer to this question will depend on more specifics. Please call the Lawrence Police Department and ask to speak to Sgt. Bill Cory. Give him the details of your accident, and he will be able to assist you with this question.
